It is important to understand that an Administrative Review is not an opportunity to present a completely new case. it is a legal mechanism designed to correct errors made during the original decision-making process. When used correctly, it can lead to a successful overturn of a refusal.

What is an Administrative Review?

An Administrative Review is a request for the Home Office to re-examine a visa or immigration decision to determine whether:

  • The decision-maker made a factual or legal error
  • Relevant evidence submitted was overlooked or misunderstood
  • Immigration rules or policies were incorrectly applied

If such an error is identified, the decision may be withdrawn and corrected in your favor.


When Can You Apply for an Administrative Review?

You may be eligible for an Administrative Review if:

  • Your visa application has been refused and the decision letter states that Administrative Review is available
  • You believe the refusal was based on incorrect assessment of your documents or circumstances
  • You applied under eligible routes such as student visas, skilled worker visas, or certain settlement routes

Important: Not all visa refusals qualify for Administrative Review. Some decisions may instead carry a right of appeal or require a fresh application.
